TRUTH OR LIE ?
Some of our leaders have practiced the art of propaganda with the best of the propaganda experts from around the world. Our all time winner, for our government, at any time, through out history, goes to ONE SESSION of our United States Supreme Court, after the civil war, for the following whopper:
"Sovereign immunity is based on the English Common Law principle that a subject cannot sue his King. It is well known that a King can do no wrong, therefore no one can sue the King."
Variations on the above tall tale have been taught in our law schools, grade schools and colleges through out the history of our nation. Almost every court in the U.S. has made use of this time worn falsehood. The bad part is that it is so easily believed by the trusting citizen and so easily stated by those limited numbers of evil doers at all levels of government.
The truth in law is that no "Subject" ever granted his "King" sovereign immunity. And the last time a King ( King Charles I ) claimed immunity, he was beheaded.
The truth is that every English subject has always had the right at common law to sue any king. Though often times a king would throw up barriers, the subject would always win in the long run, because the people were on his side.
The English common law allowed suits against the king for any reason. Further, to assist the subject in his suit, a free attorney was furnished. Then to further limit the king, Parliament passed laws known as "The Petition of Right", "Monstrans de droit", and "Traverse" all to assist the Subject in his defeat of the King.
So why have our U.S. and State Supreme Courts deceived us about Sovereign Immunity? It is a simple case of greed, if the Supreme Court allows suits against the government, then you could sue the Judges themselves. THESE JUDGES HAVE BEEN UNTRUTHFUL TO US, SAYING THAT IF THEY ARE SUED, THEN THE TAXPAYER WOULD HAVE TO PAY THE MONEY AWARDED AGAINST THEM. THE TRUTH IS THAT THERE IS NO CLAUSE IN OUR CONSTITUTION MAKING THE TAXPAYER PAY THE DAMAGES AWARDED AGAINST A JUDGE. IT IS THE JUDGE THAT MUST PAY !! THAT IS WHAT MAKES THE JUDGES BE UNTRUTHFUL. THEY ARE AFRAID OF LOSING THEIR POWER AND MONEY!!
This decietfullness about immunity by the judges presents a problem of credibility because for them our common sense says that anyone should be able to sue a person in a position of trust, such as a judge or government official. So why do they keep fibbing rather that fix the problem? Again, greed and money, if sovereign immunity is shown to be the lie that it is, then, our senators and representatives; president and executive branch; judges,and police, and our agencies could all be sued. This would bring the small number of dishonest goverenment employees to their knees paying for their mistakes, OUT OF THEIR OWN POCKETS. Our citizens would no longer be stuck with this debt paying for the transgressions of dishonest public officers.
Because so much of the taxpayers money is at stake(THESE CROOKS WILL NO LONGER HAVE ACCESS TO YOUR MONEY) once this fraud is uncovered, there is little political desire to see it uncovered.
